Welcome to Seasonal Touches, operated by Bailey & Phillips Creative ("we," "our," or "us"). By accessing our website at seasonaltouchesbybpc.com and purchasing our products, you agree to be bound by the following Terms and Conditions. Please read them carefully before using our services.
Our store is powered by Shopify, which enables us to provide services to you. These Terms, together with our Privacy Policy and Refund Policy, govern your use of our store and all purchases made through it.
Custom orders are subject to additional terms. Please review our Custom Order Terms & Conditions before submitting a request.
We reserve the right to refuse or cancel any order at our discretion, including but not limited to suspected fraud, policy violations, or intellectual property concerns.
1. Eligibility & Account
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use this site or place an order. By using this site, you confirm that you meet this requirement and that you have given consent for any minor dependents to use the site on devices you own or manage.
To access or purchase from our store, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, or assign your account to any other person.
2. Product Fulfillment
All of our products are made to order using Printify, a print-on-demand platform. We do not stock items or keep inventory. Orders are printed and shipped only after payment is received. Production times typically range from 2-10 business days, depending on product type and order complexity. Shipping time depends on your location and the shipping method selected.
We have made every effort to accurately represent our products. However, colors and product appearance may vary depending on your device's screen settings. We do not warrant that the appearance or quality of any product will meet your exact expectations as depicted on screen.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time.
We are not responsible for fulfillment or delivery delays caused by Printify or shipping carriers.
3. Pricing & Payments
All prices are listed in USD and are subject to change at any time without notice. The price charged for a product will be the price in effect at the time your order is placed, as shown in your order confirmation.
Unless otherwise stated, posted prices do not include applicable taxes, shipping, or handling fees. We accept secure payments via Shopify Payments, PayPal, or other approved payment methods.
We may offer promotions from time to time that affect pricing. Promotion terms will govern in the event of any conflict with these Terms.
You represent and warrant that: (i) your payment information is true, correct, and complete; (ii) you are authorized to use the payment method provided; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay all charges, including applicable taxes and shipping fees.
4. Refunds & Returns
We do not accept returns, refunds, or exchanges due to buyer's remorse or incorrect size selection.
However, if you receive a damaged, misprinted, or defective item: contact us within 7 days of delivery to report the issue; approved items must be returned within 30 days of delivery; provide your order number and photo(s) of the issue; once approved, we will replace the item at no cost to you.

5. Shipping & Delivery
Estimated delivery times are provided during checkout but may vary and are not guaranteed. We are not responsible for lost or delayed packages caused by shipping carriers, customs processing, or events outside our control. Once your order is transferred to the carrier, title and risk of loss passes to you. Orders with incorrect shipping addresses provided at checkout are not eligible for refunds. 6. Intellectual Property
All content on this website, including logos, designs, images, product descriptions, graphics, and text, is the property of Seasonal Touches / Bailey & Phillips Creative and is protected by U.S. copyright, trademark, and other intellectual property laws.
These Terms permit you to use our site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from this site without our prior written consent. All rights not expressly granted herein are reserved.
Our name, logo, product names, designs, and slogans are trademarks of Seasonal Touches / Bailey & Phillips Creative. You may not use such marks without our prior written permission.
Customers submitting custom designs are solely responsible for ensuring they have the legal right to use any submitted content. We are not liable for customer-submitted materials that infringe on third-party trademarks or copyrights.
7. Use of Third-Party Services
We rely on third-party platforms such as Shopify and Printify to operate our store and fulfill orders. By using our store, you agree to the terms and functionality of these services, over which we have limited control.
You may also be provided access to optional tools offered by third parties as part of the Services. We provide access to such tools "as is" and "as available" without any warranties or endorsement. We are not liable for your use of any optional third-party tools.
Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites. If you leave our site to access these links, you do so at your own risk.
8. Relationship with Shopify
Seasonal Touches is powered by Shopify, which enables us to provide services to you. However, any sales and purchases you make in our store are made directly with Bailey & Phillips Creative / Seasonal Touches.
By using our Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Seasonal Touches, including any injury, damage, or loss resulting from purchased products or services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us.
9. Privacy Policy
All personal information we collect through our Services is subject to our Privacy Policy, available at seasonaltouchesbybpc.com. By using our Services, you acknowledge that you have read and agree to our Privacy Policy.
Because our store is hosted by Shopify, Shopify collects and processes certain personal information about your access to and use of our Services. 11. Custom Orders
We offer custom and made-to-order apparel for personal, business, and event use.
By submitting a custom order request, you agree to our Custom Order Terms & Conditions, you confirm that you own or have permission to use any submitted designs, and all custom orders are final sale and cannot be returned or exchanged.
Production for custom orders will not begin until final design approval and full payment are received.
We reserve the right to refuse any custom order that violates intellectual property laws or our content guidelines.
12. Errors, Inaccuracies & Omissions
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice.
13. Prohibited Uses
You may access and use our Services for lawful purposes only. You may not use our Services for any unlawful, malicious, or fraudulent purpose; to violate any applicable laws, regulations, or ordinances; to infringe upon our intellectual property rights or the rights of others; to harass, abuse, harm, defame, or intimidate any person; to transmit false, misleading, or deceptive information; to send unsolicited commercial messages or spam; to impersonate any person or entity; to upload or transmit viruses, malware, or any other malicious code; to collect or track personal information of others without consent; to use bots, scrapers, AI agents, or automated tools to access or interact with the Services without our written permission; or to interfere with or circumvent security features of the site.

We will notify you of any indemnifiable claim promptly. We may control the defense and settlement of such claims at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent.

These Terms shall be governed by and interpreted in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. You and Seasonal Touches consent to the exclusive venue and personal jurisdiction of the courts located in Indiana for any disputes arising under these Terms.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and this determination shall not affect the validity and enforceability of any remaining provisions.
21. Waiver & Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with our Privacy Policy, Refund Policy, and any other policies posted on our site, constitute the entire agreement between you and us regarding your use of our Services, and supersede any prior agreements, communications, or proposals between you and us.
22. Assignment
You may not transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent. Any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
